End User License Agreement for the Monumental Ross Application
Before registering on the app, it is mandatory for every User to carefully read this End User License Agreement (hereinafter referred to as the 'Agreement'). The use of the Monumental Ross app implies the User's full acceptance of this Agreement, including its General Terms. Such acceptance is equivalent to the User's handwritten signature. The Publisher reserves the right to modify it at any time.
Definitions
The following terms are defined as follows:
Application: the Monumental Ross application and the set of pages and screens contained within it.
Database: the product database used in the application.
Service: monument presentation services.
Monuments: structures of historical, artistic, or cultural significance erected to commemorate or celebrate events, ideas, people, or deities.
Editor: a natural or legal person responsible for the editing and content of the application.
User: one who uses the application.
Store: online platform (Google Play Store and Apple Store) used by the Publisher to publish the Application.
Purpose
The main purpose of the application is to facilitate the recognition of monuments by providing users with an interactive experience that allows them to simultaneously obtain information and details. The application proposes a system to enhance the enjoyment of historical, cultural, and tourist information by ensuring immediate access to the historical description of monuments, encouraging users to explore and deepen their knowledge, and making the visitor's experience as quick and comprehensive as possible.
Database
Monumental Ross does not guarantee the total reliability of the Database and the exact presentation of analyzed monuments. Monumental Ross does not perform any autonomous analysis in monument recognition. The information provided by the application reflects that provided by third parties, and errors in recognition and analysis may occur. Any errors can be reported through the Application.
Account in the Application
Creation
Users creating an account on the Application can access it using the credentials provided during registration and by utilizing authentication platforms such as Google and Apple.
Suspension or Deletion
The Publisher has the exclusive right to suspend access to the Application or delete the account of any user who violates this Agreement. This violation may include, but is not limited to, the intentional provision of incorrect information in the Application. It is important to note that if a user is excluded, this does not entitle them to claim compensation for any damages suffered. The exclusion of a user does not prevent the Publisher from taking legal action against the user if the circumstances warrant it.
User Rights and Duties
The User agrees to: - Make personal and non-commercial use of the data provided by the Application; - Not use the data proposed by the Application for personal gain; - Not make incorrect additions or modifications to the description of monuments. Every User is free to close their Account on the Application. To do so, the user must send an email to the Publisher indicating their desire to delete their account or follow the deletion procedure in the Application.
Changes to Content
Users are encouraged to report any errors to the Publisher, who will do their best to update the Database. The User agrees to comply with the laws and regulations in force, as well as the terms of use. The Publisher is not obliged to verify any changes requested by the User.
Publisher's Rights and Duties
Access to the Application
The Publisher informs that the information entered in the Application is stored on servers of an external service provider to which the Publisher subcontracts the hosting service. The Publisher cannot be held responsible for technical unavailability of the connection, particularly due to force majeure, maintenance, update, modification, intervention by the host, internal or external strike, network failure, power outage, or even incorrect configuration or misuse of the user's device. The User acknowledges awareness of the limits and constraints of the Internet network and, as such, recognizes in particular the impossibility of a total guarantee of data exchange security. The Publisher is not responsible for damages resulting from the use of the Application, such as data loss, intrusion, viruses, service interruption, or others.
Responsibility
The Publisher cannot, under any circumstances, be held responsible for: - Any direct or indirect damage, particularly in terms of loss of profits, foregone earnings, loss of customers, or data that may result from the use of the Application, or conversely from the inability to use it; - Malfunction, unavailability of access, improper use, improper configuration of the User's device, or even the use of a little-used or obsolete device by the User; - The content of links or external sources accessible to the User from the Application; - The content of information related to the description of analyzed monuments and any related assessments and/or modifications. The User acknowledges that the Publisher assumes no responsibility for providing data related to the analyzed monuments and cannot be held responsible for their content. The User expressly acknowledges using the Application at their own risk and under their exclusive responsibility. The Application provides information for indicative purposes. The Publisher does not guarantee the accuracy, completeness, or exhaustiveness of the information and data in the Application. The Database is subject to changes, especially based on monuments added and/or modified by the User and the Publisher. The Publisher excludes all liability for errors in the Database, particularly regarding information related to monument analysis. Therefore, it is the User's responsibility to verify the accuracy of the information found to ensure they obtain updated information. The Publisher cannot guarantee the relevance of the information and recommendations in the Application. The Application is not intended to replace a tour guide.
Intellectual Property Rights
The exclusive use of the Monumental Ross trademark, logos, software, graphic elements, databases, and more generally all content offered by the application is for the exclusive benefit of the publisher or its potential partners. Anyone making communication, representation, reproduction, embedding, distribution, and redistribution incurs sanctions, particularly under the terms of the Intellectual Property Code, the Civil Code, and the Commercial Code. Any member who is the author of such attacks on protected elements is liable to have their account canceled without notice or compensation, and this cancellation does not constitute damage to them, without reservation for possible subsequent legal proceedings against them, at the initiative of the Publisher of the Application or one of its agents.
Competent Judicial Authority
Competent jurisdiction for users of the European Union. Pursuant to Regulation (EU) No. 1215/2012 of the European Parliament and of the Council of December 12, 2012, concerning jurisdiction, recognition, and enforcement of decisions in civil and commercial matters, exclusive jurisdiction to hear any dispute arising from or in connection with the Contract belongs to the judicial authority of the State in which the user is resident or domiciled.
Deletion of the Account
The User can delete the account from their mobile phone through the Monumental Ross application. To delete the account: - Open the Monumental Ross application; - Click on the top right icon to access the profile screen; - Click on the red button at the bottom that says 'Delete your account.' By deleting the account, all associated data will also be deleted.
Incompatibility of Monumental Ross
The application may be incompatible with your phone for one of the following reasons. For example: On iOS: - You do not have at least iOS 10. - You have an iPhone 3, 4, or 5. On Android: - You do not have at least Android version 5.0. - Your phone has been rooted. - You have a phone that does not meet basic SafetyNet integrity criteria. - Your RAM is less than 256 MB. - The Google Play Service app is not authorized on your phone.
Use of the Monumental Ross Trademark
For reasons of independence, Monumental Ross does not authorize, under any circumstances, brands, manufacturers, and distributors to use the Monumental Ross trademark in any form of communication. The logo can be used by journalists for informational purposes.
